Multi-jurisdictional Compliance: Yahoo Inc. Harvard Case Solution & Analysis

Yahoo!, Inc operates a number of web sites, including the auction catalog search engine on Yahoo.com (in English), as well as regional site Yahoo.fr (written in French). At the auction, Yahoo, various third parties posted on the sale of Nazi propaganda and Related Third Reich related memorabilia, including Adolf Hitler's Mein Kampf and the "Protocols of the Elders of Zion" (a notorious anti-Semitic report). In April 2000, the French International League against Racism and Anti-Semitism (also known as LICRA), a non-profit organization dedicated to the elimination of anti-Semitism, has sent "cease and desist" letter to Yahoo. LICRA Yahoo warned that advertising and / or sale of Nazi memorabilia and racist literature or objects for the auction have been banned in France. Another non-profit organization dedicated to the elimination of anti-Semitism, L'Union de Etudiants Juifs-de-France, joined LICRA and took Yahoo to court. This case discusses how foreign courts have far to assume jurisdiction over e-business. It also shows that e-business is faced with an increased risk of liability abroad as a country to support their efforts to put up borders in cyberspace.
