X-IT and Kidde (A) Harvard Case Solution & Analysis

Involves running, X-IT Products LLC, whose founders developed an innovative, lightweight and easy to use - even more - an escape ladder. After X-IT filed a patent application on a ladder in the United States, X-IT approached Kidde PLC, one of the largest suppliers of fire safety in the world. Negotiations under license X-IT invention or buy X-IT followed. The parties entered into a confidentiality agreement, which gave the patent attorney Kidde access to X-IT confidential application for a patent for the narrow purpose of reporting Kidde whether patent claims were weak or strong. After the X-IT founders saw Kidde representatives display stairs in a major exhibition, which was almost identical to the X-IT ladder, X-IT CEO had to decide what to do next.
