The case is about Teck Cominco Alaska Inc., which operates in a zinc mine, the Red Dog mine. The company obtained the authority to operate the mine under Clean Air Act and Alaska State Implementation Plan. In 1996, the company initiated a project where it was funded from the State to increase production. ADEC, in coordination with Cominco, issued a draft PSD permit for the technical analysis report where it concluded the low NOx for the MG- 5 and MG – 17.

The credibility and its worth in the environment was an issue, which had been questioned from various corners of the authorities.
